Cop-shooting teen gets 25-50 years in prison
. Donyea Phillips, a 17-year-old a runaway, who had been squatting with a cousin in an East Frankford rooming house, was sentenced to 25-50 years in prison for shooting and wounding two Philadelphia drug officers serving a search warrant at the house, reports The Philadelphia Inquirer. Phillips, a suspected crack dealer who pleaded guilty in July to two counts of attempted murder and related charges, apologized to Officers Christopher Reed and Stephen Holts. Phillips insisted to Common Pleas Court Judge Glenn B. Bronson that he did not know police were trying to come through the door when he blindly fired through a window Nov. 13. “I was afraid for my life,” Phillips told Bronson, adding, “All I’m just asking is not to lock me up and throw away the key, because I’m changed.” The prison term drew gasps from some of the dozen relatives in court to support Phillips because it’s above the 5- to 10-year minimum recommended under state sentencing guidelines. However, it was also less than the 32-1/2 to 65 years requested by the prosecuting attorney. “I think this sentence was clearly excessive,” said defense attorney James A. Lammendola. He said he would file a motion asking the judge to reconsider the sentence. Explaining his sentence, the judge credited Phillips with accepting responsibility by pleading guilty and acknowledged his grim upbringing: “You had a horribly deprived childhood, there’s no doubt about that,” Bronson said. Kirk Heilbrun, a forensic psychologist hired by Phillips’ defense, testified that Phillips was the oldest of six children. Heilbrun said Phillips experienced mental and physical abuse by his parents and was largely responsible for caring for his siblings. But the judge said Phillips’ background did not excuse the fact that he was squatting in a house, selling crack cocaine and spending $100 a day for marijuana. “Sadly, other people have been in similar situations, but they don’t hole themselves up in a crack house and fire a gun at police officers,” Bronson said.
I would first and formost respond to the statement that if the roles had been reversed and it had been a white young man,that shot a black man or an officer, and that shot was in the lower extremities like the officers there sentencing wouldn’t have been the same. I currently have one of his brother and contest that they truly had a very, very hard upbring, both physical and mental abuse, and if you have any since of the mental aspect of child and how there up bringing can affect and shape the person there aspire to be and frame of mine post the tramatic up bringing

No way, that is not on. The judge clearly took the piss with the sentencing. Even though he fired shots at the police officers and could’ve killed them, they should have waited until it was safe before busting in. And clearly it was not cos they got shot. C’mon this youth was squarting in some ~*$# hole, selling crack and smoking more weed than Fela Kuti back in the seventies so you can’t say paranoia is out of the question. Once he gets agitated it is obvious that he’s gonna be letting off shots. Dont forget that this guy has been through some ~*$# at home and living in the streets, look at his upbringing. The judge was harsh and my man got caught slippin’. He should go for an appleal and keep his head up.

Everytime this white government of ours gets ahold of a situation dealing with a black person, they try to discreetly make is worse than what it really is or deserve. Yes, he should be punished but not to that degree, considering his upbringing, age, and the fact that they didn’t get killed. Where were his parents? I just don’t understand, especially when there’s whites who commits similar crimes or worse, that either gets off scott free because of their upbringing, get diagnosed with some type of medical illness, and or do less time. As the young man said, he didn’t know that it were cops coming through his front don’t and I can see how that can be typical considering that he is selling drugs. I’m not condoning his actions by any means, but everyone should be treated fairly, even if they have committed a crime because after all, every person that commits a crime are not criminals, it’s how the law has it set up to be that way. I know because I have seen good hard working people, that has never been in any trouble get a felony because of something that they weren’t aware of being a felony. For example spanking a child with a switch, and most of them were black. I’m not a saint but I do know that Jesus said if you have not sinned cast the first stone.
