Jena Judge Is Removed For His Remarks

August 4th, 2008

The defense team doubted that J.P. Mauffray could render an unbiased decision.

Jena
The attorneys for five of the six Black teens accused of assaulting a White schoolmate in Jena, La., two years ago didn’t believe Judge J.P. Mauffray when he said he could deliver a fair verdict in the defendants’ upcoming criminal trial. And neither did the judge appointed by the state Supreme Court to determine whether he should be dismissed for calling the youth’s “trouble-makers” and a “violent bunch. On Friday, Judge Thomas M. Yeager ruled that Mauffray should step down. “The right to a fair and impartial judge is of particular importance in the present cases,” Yeager wrote in his decision. On trial are Jesse Ray Beard, Robert Bailey Jr., Carwin Jones, Bryant Purvis and Theo Shaw, who now face aggravated second-degree battery charges for allegedly beating Justin Barker on Dec. 4, 2006. Beard is charged as a juvenile. Only one of the so-called “Jena Six” has been tried: Mychal Bell, who was convicted in juvenile court last June of aggravated second-degree battery. Initially, Bell and the other youths were charged with attempted murder, but the prosecutor reduced the charges amid an ocean of criticism from Black leaders and civil libertarians. The case stoked racial tensions in the tiny central Louisiana town, and tens of thousands of protestors, led by the Rev. Al Sharpton, descended upon Jena on Sept. 20. It seems like the case that just won’t go away. “Whatever ultimately happens concerning the judge, this does not mean these cases go away,” District Attorney Reed Walters said. “It will just take longer to get them to trial. However, I may seek to have the decision overturned.” Do you think removing the judge was the right decision?

I am glad to see the judge step down. This action is justice at its best. One down one to go. We need Redd Walters to step down next. The case should be tried outside of Jena with a group of their peers. I would love to see some diversity in the jury pool. In the end God will be glorified.

hell yea this whole incident is unfair and i believe in the mind of the white community these young men have alredy been convicted what abot the convictions of thise responsible for hanging all these nooses?

Delance Said on

it was a mistake to even allow the judge to make a decision in the case. Why! What a about the black student that was beaten weeks before the Jena 6 incident. What type of legal action did the law enforcement , Board of education ,prosecuting attorney , and etc take in prosecuting the white children involved in the crime. Trouble comes in many different shapes, forms, and color’s . The judge was trouble. Its good he was removed from the case .

i dont get why the white kids didnt have nothing done to them? why they didnt go to jail? our black kids did nothing wrong. free the jena six!…for good!

monique Said on

yes I believe it was a good thing they removed the judge, because he should not prejudge those kids. That is the whole the big picture these are just kids. They do stupid stuff I know I did. What’s stupid is how a boy fight is even being tooken this far. Yeah he was injured, but he will survive and think about what he says to ppl before he says it. At least certain ppl ! Leave those kids alone, and let them go !

Well, personally they been getting away with shyt for years.. Soon as some Black folks stand up, they wanna throw ‘em in jail. I think it should be throwed out altogether. They getting away with killing blacks still, behind badges, and the noose shyt, the musuem that was recently shut down cause they were proud to display the horrors that blacks have had to endure. I am just so appauled with all this crap. The sooner they realize this is not the old days and Blacks are/will defend themselves, the better off everyone will be.

So what would have been the charge if they would have been hung in those trees. Of course none, no one would have known what the hell happened.
If you taunt anyone enough, even a dog, he eventually bite you ass back.

i think it was the right decision because he is just satan in progress but God’s people always fight back and they all should be aquitted of their trials and i think that it would resolve everything!!!!!!!!!!!!!!!!!!!!!!!!

I agree with the decision. If a judge cannot render an impartial decision then he shoud recuse himself from a case. We have to remember that judges are human too and just like we sometimes allow biases to get in the way of doing what’s right, I’m sure judges find themselves in the same predicaments. So, I really hope that even on appeal, the decision will be affirmed and the town of Jena can find a judge that can be impartial and maybe rule for some justice for everyone.

Us black people need to be smarter than the devil. The black race been going though for a long time. I use to live in the white neiborhood and one day my two sons did not come stright home from school so I started looking for them and still did not know where they was so I called the police and put out missing person report so I came home with the police to see if they came home yet and the white people was all out side talking and looking so this one white girl look at me and smile like she was happy that my kids was missing, my sons was found they went to a friend house instead of coming home first. What I’m trying to say is how that would of look getting angry at the white girl for laughing in my face, you can’t let nobody cause you to get in troble, them white people try me more than one time, but I use wisdom, white people starts stuff to sometime they do it in a sneaky way but you got to be the smart one to not let no one cause you to lose noithing that God bless you with. you all need to read up on some knowledge in the holy bible… God bless…Jesus all the way….

I think it is good he’s being made to step down, lord knows he would not have done it his self. With a judge that not impartial, you dont have a chace. The whole thing is sad, because it say’s in certain places, especially back south and up north in prodominently white areas, whites can do what they please and we cant. We have to be smart, they already think most of us arent. I wish the Jena young men the best I cant amagine what their parents are going through, but I have young black adult children. Keep your heads up and praying to the only person that can help you. The Lord

Judge J.P. Mauffray should have been removed for making such comments. He has made a very childish mistake by presuming that they are “Trouble-Makers” and a “Violent Bunch”, he hasn’t even heard their case yet. Regardless of rather he heard the case or not, as a judge he cannot make personal comments. Those comments prove that he has let his personal feelings get involved in the case. Therefore, it is impossible for him to give them a fair trail.
