National News: L.A. DA Says High-Profile Hospital Death Is No Crime; Famed Death-Row Inmate Wants Another Trial; Affirmative Action Haters Want The Program Banned

July 9th, 2008

Like the recent N.Y. case, Edith Rodriguez was ignored as she yelled in pain on the floor
Prosecutors in Los Angeles will not lodge criminal charges against workers at a predominantly Black hospital where a woman died screaming in pain as staff ignored her, The Associated Press reported. City officials said in a report released Tuesday that there was too little evidence to charge a nurse and other staff at the former Martin Luther King, Jr.-Drew Medical Center in the death of Edith Isabel Rodriguez, a 43-year-old mother of three, according to AP. Rodriguez died of a ruptured bowel on May 9, 2007. Los Angeles Police took her to the emergency room after finding her yelling for help in front of the hospital. She had been released from the emergency room just three hours before, given a prescription and told to see a doctor. Upon her return visit, a nurse told her, “…[T]here’s nothing we can do.” Rodriguez fell on the floor and writhed in pain for 45 minutes as hospital workers toiled at their desks and patients looked on. The case is eerily similar to a June 19 case at the Kings County Hospital in Brooklyn, where 49-year-old Esmin Green died after falling to the floor and remaining there for about an hour as staff ignored her. In that case, Green’s family filed a $25 million lawsuit this week.

Famed death-row inmate wants another trial

Mumia Abu Jama
Mumia Abu-Jamal, the journalist and former Black Panther member who is in prison for killing a Philadelphia police officer 27 years ago, is asking for a new trial. His attorneys argue that the federal appeals court that denied him a new trial in the killing of Officer Daniel Faulkner should have pondered the question of whether prosecutors deliberately denied Blacks the right to serve on the jury, which violates a later Supreme Court ruling. Robert R. Bryan, who represents Abu-Jamal, and Widener University law Professor Judith Ritter, asked the three-judge panel and the full Third Circuit court to review the case again. Convicted in 1982, the 54-year-old Abu-Jamal gained legendary status while on Pennsylvania’s death row. He is the author of several books, and his taped commentaries are aired on radio shows nationwide. He has maintained his innocence from the beginning.

Affirmative action haters want the program banned
Despite recent failures to get anti-affirmative action measures on ballots in Missouri and Oklahoma, supporters of such initiatives say they’ll reap success in Nebraska and Arizona this time around. They contend that they’ve gathered the necessary signatures, unlike in Missouri and Oklahoma. But opponents of efforts to ban affirmative action aren’t sitting still while the program they say is a needed to ensure equal opportunity for qualified minorities is held back by race. They are going after Arizona signature-gatherers in a lawsuit, alleging that they are using deceptive means to trick supporters of affirmative action into signing their petitions. They point to the name of the anti-affirmative action measure as an example – the American Civil Rights Initiative. Petitioners traditionally tell unsuspecting individuals that they are trying to ensure equal opportunity in hiring, knowing full well that potential signers will be duped into believing that they helping ensure the survival of affirmative action, critics contend. “There’s a significant difference between submitted signatures and valid signatures,” David Kramer, head of Nebraskans United, which opposes the measure, told The Associated Press. “We’ll wait to see the outcome of that process before litigation.” If the anti-affirmative action forces are successful, a constitutional amendment would make it illegal for public entities to give preferential treatment on the basis of race, sex, color, ethnicity or national origin.

I hope the Anti-Affirmative action legislation does not go through. Just goes to show you-read before you sign. And even then tricky language in the petition duped people. All these “studies” done by news programs over the last 10 years (i.e. Primetime did an experiment, so did 20/20) prove that there is STILL discrimination in hiring , job advancement, and housing. But of course, proponets of this Anti-Affirmative action don’t see that-even with all the studies and articles done on the subject. The fight ain’t over just b/c we have “civil rights”

The only Reason that the hospital is being cleared , the huge law suite that will follow in a ruling of wrong full death. But the family of miss Rodriguez will win in civil court.

HOSPITAL DEATHS – The MLK, Jr. Hospital was blatantly negligent in treating this woman who had been there 3 hrs before she died on the floor of the ER like an animal. EVERYBODY who was present and licensed to treat patients should be held accoutable for this. It is a shame that this has happened. Who do people trust in the medical field these days and why have an ER if you are not going to treat people who are desperately ill?

ABU-JAMAL If he was not given a fair trial then it should be reopened and see what happened.

AFFIRMATIVE ACTION – It remains to be seen how this will play out. If it is something for the minorities, most people will be against it because the powers that be don’t want us to have anything if they could have their way and they are not willing to treat us as others are treated, so…

I am for affirmative action because that is the only reason i was hired i came in and as most corporate places where their is room for advancement is mostly white we had no black men in the corporate office and now i moved to a new department and I am teh only black female and we have 3 black gentleman so that is a total of 4 in an office of almost 80. Do you really think that is wasn’t a black individual that was more qualified but didn’t get the job yeap….but in the warehouse that is where all the black men are and more black women i knew they were somewhere we need that sad but we need it i am sure i would not have been given the opportunity to work and use my skills and education if it wasn’t for that…ok here is an example when i started working i was getting paid nothing i have an AA degree in that field and 2 years experience even after my review i had taken on lots of responsibility and they gave me 50 cents but anywho an member of our executive committee requested that i move up bc i do a great job never complaining doing this without being asked just going above and beyond and he brought me over to the new position and he paid me but the girl that was coming in the replace me (white) we have the same AA degree except i graduated in the top 3% of my class and had honors everything and i think i had a little more experience in Accounts payable but they started her salary like $3 more than mine but then she couldn’t get the work done we had customers complaining so now they took away half her duties now if that had have been me i would have been fired a long time ago there is no way i would have been able to keep job and i can’t do the job but none the less i have spoken with my ex supervisors and they say they didn’t realize how much i meant to the accounting department until i was gone the VP of finance even offered me a pay equal to what i am making now to stay to little too late

I am angry angry angry at the hospital that let that lady die like she did that day. I 100% believe that the hospital and the staff that was there that night should be held responsible for that lady’s death. I am a nurse and as nurses we are taught in school that we are not only nurses bur advocates for the patients as well. Did these people just simply didn’t care about this person or for any other patient that comes through those hospital doors? I think that hospital is a disgrace and the people that were there that nignt is a disgrace to the medical profession and Martin Luther King, for which the hospital is named after! Martin Luther King must be rolling over in his grave knowing that everything he fought for and died for is all in vain, according to this episodes. I am pretty sure there are a number of others that haven’t been treated fairly and treated with such negligence that’s it’s pathetic! Law makers need to wake up and take a stand and stop letting our people die like stray dogs in the street. Come on people we are talking about a human life. Now how is society going to explain to this lady’s kids about what and why this has happened to their mother! America this is PATHETIC ABSOLUTELY PATHETIC!!!!!!!

Hire me cause I’m qualified. Discrimination is already illegal. Pass me over and I WILL sue you if you hire less qualified because of my minority status. Affirmative action offices are still open in states where this law has already been passed. We need more economic affirmative action. Let’s help those that want to GET qualified. These loud mouth groups like BAMN are a shame in this day and time. Most of dont’ have a job cause we’re not willing to say “Welcome to QuikTrip. Can I help you?”

Hello Everyone,
Comment on both. The hospital know they were absolutely WRONG for not helping that poor lady if i were her family id shut them down with the lawsuits i filed against them. The police had to take her inside what kind of crap is that. I also live in Nebraska where they are trying to pass this law and trust me they are very racist here so it doesnt surpise me one bit. What a shame, but i know god has it all under control. You reap what you SOW!

I wish that the King family ask the hospital not to use their father name anymore. I have been in the hospital quite a few times and its scare me every time I go because many of the hospitals getting to be like third world hospital in this country. Believe me God seen these people who sit there and let that woman die. God gave ability to these people to save that women and they let her die like a dog, (oh they would have saved a dog). The people in this city should be outrages. If the people in this city, especially minorities would get up and boycott this hospital for better services, the people who run this hospital will really start looking into things because boycotting for better services will really make them look bad.
