No Fine For ‘Nipple-gate’
July 22nd, 2008Network’s penalty for Janet Jackson’s “wardrobe malfunction” is dismissed.
A federal appeals court has thrown out the $550,000 indecency fine that the FCC assessed against CBS for singer Janet Jackson’s mishap at the 2004 Super Bowl. CBS, which broadcast the top-rated football event, denied responsibility for Jackson’s widely viewed performance, during which singer Justin Timberlake exposed her breast. But 90 million viewers heard Timberlake sing the lyrics, “Gonna have you naked by the end of this song” before he tore her costume, raising questions about whether the exposure was accidental. A three-judge panel found that the FCC had acted hastily in fining CBS, since it usually levels fines only when stations engage in deliberate “shock treatment.”

Oh they need to give this a break. Men and women have seen breasts – on nature channels and those you have been breast fed. Waste of taxpayers dollars for this to proceed in court or still be discussed.

It’s about time the FCC moves into THIS century because while some stories claim it was an accident and others claim it was part of the show…it was a brief look at Janet’s breast and not a view of her having sex on stage. You see more watching National Geographic, but they don’t fine stations for that. Why didn’t they go the distance about Steve Austin’s use of the “N-word” in The Longest Yard that was seen on national television during prime time??? Personally….the FCC isn’t following their own policy and I’m glad the legal system was able to block this crazy fine.
