Wesley Snipes will not go to prison quietly.
Snipes, who was convicted of federal tax evasion a year ago asked a federal appeals judge in Atlanta to review his conviction.
He was sentenced to three years in federal prison for failure to pay $2.7 million in back taxes.
Snipes, 47 is free on bond until the situation is resolved.
