<p>Attorneys for Brian Nichols, the 36-year-old Atlanta man accused of killing his judge, a court reporter and two law-enforcement officials during a daring courthouse escape three years ago, does seem as insane as he wants everybody to believe, the presiding judge said Tuesday. Superior Court Judge James Bodiford did not hear expert psychiatric testimony, but he said he also hasn&#8217;t heard anything that would lead him to accept Nichols&#8217; claims that his diminished mental state is the reason for his testimony. Nichols had pleaded not guilty by reason of insanity. The fact that defense witness Vincent Velazquez, an Atlanta Police detective, testified that Nichols was not only coherent but clear and articulate following the alleged murders helped undermine the insanity argument &#8220;that Nichols had suffered from a delusional compulsion at the time of the killings,&#8221; <em>The Atlanta Journal-Constitution</em> reports. &#8220;He was very up front and very detailed and meticulous in telling me what happened,&#8221; Velazquez said. &#8220;It was one of the easiest interviews I&#8217;ve ever done.&#8221; </p>
<p><strong>Anti-affirmative action measure dies in its tracks. </strong>Advocates of an Arizona initiative aimed at doing away with affirmative action programs have finally given up the fight &#8211; at least for now. Last week, the head of the Arizona Civil Rights Initiative &#8211; which critics say is deceptively labeled &#8211; told the <em>East Valley Tribune</em> that Maricopa County Superior Court Judge Edward Burke gave supporters until this week to prove that a major chunk of the signatures they had accumulated to force a ballot initiative were not bogus. Max McPhail had claimed that he had garnered more than enough signatures from registered voters, and that Proposition 104 had earned a rightful spot on the November ballot. He apparently no longer thinks so. &#8220;Because of the upcoming primary, Maricopa County said we could have only two computers to check 4,000 signatures,&#8221; he said. &#8220;It takes about six minutes to check each signature. It&#8217;s not humanly possible to check all the remaining signatures (the county declared invalid) to present on Tuesday.&#8221; But the fight isn&#8217;t completely over, McPhail says. He says that a new ballot initiative will be introduced in the 2010 election. If passed, the measure would prohibit the consideration of race or gender in any state hirings or college admissions. However, state Rep. Kyrsten Sinema (D-Phoenix) says the initiative won&#8217;t pass now or ever because she&#8217;ll work to expose it for the divisive program it is. &#8220;When they understand it&#8217;s going to eliminate programs that help, for instance, young Latina women prepare for college, like the Mother-Daughter Hispanic Program, they don&#8217;t want to eliminate those programs,&#8221; she said.</p>

The study, reports <em>The New York Times</em>, shows that in New York there are 72 new cases of HIV infections for every 100,000 people, compared with 23 per 100,000 nationally. The findings, based on a new formula developed by the federal <a target="_blank" href="https://secure.bet.com/owa/,DanaInfo=beti-ex1,SSL+redir.aspx?URL=https%3a%2f%2fsecure.bet.com%2ftop%2freference%2ftimestopics%2forganizations%2fc%2fcenters_for_disease_control_and_prevention%2f%2cDanaInfo%3dtopics.nytimes.com%2bindex.html%3finline%3dnyt-org" title="More articles about the Centers for Disease Control and Prevention.">Centers for Disease Control and Prevention</a>, estimated that 4,762 New Yorkers contracted HIV in 2006, the most precise estimate the city has ever offered. But city officials stress that because the method of estimating infections was new, it could not be said definitively whether the number of new infections in the city had increased or decreased from previous years. Blacks, and men who have sex with other men, are the groups at greatest risk of contracting HIV, the study found. Blacks made up 46 percent of the newly infected; Hispanics, 32 percent; and Whites, 21 percent. Men accounted for 76 percent of new HIV infections and women for 25 percent. (The figures exceed 100 percent because of rounding.) Sex between men was the main cause in 50 percent of new infections; high-risk heterosexual sex in 22 percent; intravenous drug use in 8 percent; and unknown or uncertain causes in 18 percent. Over all, the study found some interesting differences between national and local rates of new HIV infections. Nearly two-thirds of the city&#8217;s new infections occurred in people 30 to 50 years old. Nationally, people under 30 accounted for 41 percent of new infections, compared with 28 percent in New York City. Also, within New York City, Whites were infected at four times the national rate, Hispanics at three times the national rate, and Blacks at almost twice the national rate.  <br />
<strong>The number of uninsured Americans drops</strong>. The number of Americans without health insurance dropped by more than 1 million people in 2007, the first yearly decline in seven years, U.S. Census Bureau officials announced Tuesday. The drop was driven largely by an increase in the number of children covered by government-funded programs. The overall number of uninsured dropped from 47 million in 2006 to 45.7 million in 2007, David Johnson, chief of the Census Bureau&#8217;s Housing and Household Economic Statistics Division, said during a morning teleconference. The number of children with health insurance increased to 8.7 million in 2007, up from 8.1 million in 2006. &#8220;The number of children covered by government health insurance programs increased to 31 percent from 29.8 percent in 2006,&#8221; Johnson said. &#8220;This is the main reason for the fall in the uninsured rates in children and for the fall in uninsured rates in the general population,&#8221; he said. Among Blacks, the number of uninsured dipped from 20.5 percent in 2006 to 19.5 percent in 2007. The number of people with private health insurance did not change. However, the number of people covered by government health insurance such as Medicaid increased from 80.3 million in 2006 to 83 million in 2007. People getting their health insurance through Medicaid increased from 38.3 million in 2006 to 39.6 million in 2007. Karen Davis, president of The Commonwealth Fund, a private foundation that seeks to promote a high-performing health care system for all Americans, thinks that the drop in the number of uninsured supports the argument for government-sponsored health insurance programs. &#8220;When you look at what&#8217;s really going on, the number of uninsured dropped by 1.3 million, and the increase in coverage under Medicaid and the State Children&#8217;s Health Insurance Program (SCHIP) went up by 1.3 million,&#8221; she said. This shows the importance of government-funded safety nets, she said.</p>
<p><strong>A food allergy action plan helps protect children</strong>.  Parents, teachers and school staff need to take measures to ensure the safety of the more than 2.2 million American students with food allergies, says the American Academy of Allergy, Asthma &amp; Immunology. &#8220;Open and frequent communication between parents and school staff is a key ingredient to keeping food-allergic students out of harm,&#8221; Dr. Michael Pistiner, a member of the Academy&#8217;s  Adverse Reactions to Foods Committee, said in an academy news release. &#8220;It takes a partnership to establish effective avoidance strategies and emergency plans.&#8221; The academy&#8217;s sample action plan and checklist of safety tips:  Inform the school cafeteria, teachers and other staff of what foods your child must avoid. Pack bag lunches. Your child should avoid classroom snacks and refrain from sharing food with friends. When there&#8217;s a classroom party, provide your child with safe snacks he or she can eat during the party. And push for &#8220;no-eating&#8221; policies on buses and in other settings where there&#8217;s no supervision of children. &#8220;Parents should be aware of expiration dates and keep in contact with their allergist to insure that all medication, especially self-injectable epinephrine, is replaced prior to expiration,&#8221; adds Pistiner, whose own nut-allergic son enters kindergarten this fall. Police said that 17-year-old Trevayne R. Cozart was pronounced dead at the Gwinnet Medical Center in suburban Atlanta. He had been playing with a friend when the friend’s little sister fired a weapon. Although the girl’s mother was home at the time, she was not in the room where the shooting to place, police said. No charges have been filed against the parents or the child.</p>

<p>The Stamford, Conn., branch of the NAACP, saying that police are “mentally abusing” Black youths, will hold a protest against local law enforcement on Aug. 31. The mass action will mark the first demonstration under NAACP President Jack Bryant, who took over the helm of the chapter five years ago. &#8220;I feel this plan of action is necessary as the need to begin policing our police department,&#8221; Bryant told Mayor Dannel Malloy and Public Safety Director William Callion in an e-mail a week ago. The mayor responded that he was willing to meet with Bryant, who told The Advocate newspaper that the &#8220;the time for meetings is over. This issue has been exhausted with meetings between the police department and the community. I think it&#8217;s time for action now.&#8221; Bryant says that the complaints from the African-American community have been pouring in. He says that he even witnessed one “disturbing” incident earlier this month but declined to offer details, The Advocate reported. &#8220;I approached the officers and they said it&#8217;s an investigation and they couldn&#8217;t give me any details,&#8221; he said. The incident didn’t involve a beat-down, but it was troubling, he added. &#8220;It wasn&#8217;t physical police brutality but I think mentally it was police brutality … I don&#8217;t want this to seem like we&#8217;re singling out the whole police department. I&#8217;m sure there are a lot of good police officers on the force. There&#8217;s just a few who make it seem bad for those whole police force.&#8221;</p>

Prosecutors in Los Angeles will not lodge criminal charges against workers at a predominantly Black hospital where a woman died screaming in pain as staff ignored her, The Associated Press reported. City officials said in a report released Tuesday that there was too little evidence to charge a nurse and other staff at the former Martin Luther King, Jr.-Drew Medical Center in the death of Edith Isabel Rodriguez, a 43-year-old mother of three, according to AP. Rodriguez died of a ruptured bowel on May 9, 2007. Los Angeles Police took her to the emergency room after finding her yelling for help in front of the hospital. She had been released from the emergency room just three hours before, given a prescription and told to see a doctor. Upon her return visit, a nurse told her, “…[T]here’s nothing we can do.” Rodriguez fell on the floor and writhed in pain for 45 minutes as hospital workers toiled at their desks and patients looked on. The case is eerily similar to a June 19 case at the Kings County Hospital in Brooklyn, where 49-year-old Esmin Green died after falling to the floor and remaining there for about an hour as staff ignored her. In that case, Green’s family filed a $25 million lawsuit this week.</p>
<p><strong>Famed death-row inmate wants another trial</strong></p>

Mumia Abu-Jamal, the journalist and former Black Panther member who is in prison for killing a Philadelphia police officer 27 years ago, is asking for a new trial. His attorneys argue that the federal appeals court that denied him a new trial in the killing of Officer Daniel Faulkner should have pondered the question of whether prosecutors deliberately denied Blacks the right to serve on the jury, which violates a later Supreme Court ruling. Robert R. Bryan, who represents Abu-Jamal, and Widener University law Professor Judith Ritter, asked the three-judge panel and the full Third Circuit court to review the case again. Convicted in 1982, the 54-year-old Abu-Jamal gained legendary status while on Pennsylvania’s death row. He is the author of several books, and his taped commentaries are aired on radio shows nationwide. He has maintained his innocence from the beginning.</p>
<p><strong>Affirmative action haters want the program banned</strong><br />
Despite recent failures to get anti-affirmative action measures on ballots in Missouri and Oklahoma, supporters of such initiatives say they’ll reap success in Nebraska and Arizona this time around. They contend that they’ve gathered the necessary signatures, unlike in Missouri and Oklahoma. But opponents of efforts to ban affirmative action aren’t sitting still while the program they say is a needed to ensure equal opportunity for qualified minorities is held back by race. They are going after Arizona signature-gatherers in a lawsuit, alleging that they are using deceptive means to trick supporters of affirmative action into signing their petitions. They point to the name of the anti-affirmative action measure as an example – the American Civil Rights Initiative. Petitioners traditionally tell unsuspecting individuals that they are trying to ensure equal opportunity in hiring, knowing full well that potential signers will be duped into believing that they helping ensure the survival of affirmative action, critics contend. &#8220;There&#8217;s a significant difference between submitted signatures and valid signatures,&#8221; David Kramer, head of Nebraskans United, which opposes the measure, told The Associated Press. &#8220;We&#8217;ll wait to see the outcome of that process before litigation.&#8221; If the anti-affirmative action forces are successful, a constitutional amendment would make it illegal for public entities to give preferential treatment on the basis of race, sex, color, ethnicity or national origin.</p>
