A lawsuit focusing on an alleged mystery about whether or not President-elect Barack Obama is a U.S. citizen has been tossed. The U.S. Supreme Court said Monday that it would not hear the case and refused to intervene in Obama’s move to the White House. The case was one of several, fueled by Internet rumors, that have been filed over the issue. Meanwhile, the Obama campaign has provided an Internet link to Obama’s Hawaiian birth certificate on its website for months. Legal experts have said the case had little chance of success.

Clarence Thomas challenges Obama’s citizenship. U.S. Supreme Court Justice Clarence Thomas has asked the high court to consider an East Brunswick, N. J., attorney’s lawsuit, challenging whether Barack Obama is really eligible to be president, reports The Afro newspaper. Thomas took the action after Justice David Souter had already rejected a petition for the court to stop the Electoral College from meeting on Dec. 15, which will certify Obama as the 44th president of the United States and its first African-American president, the Black-owned newspaper reports. The court has scheduled a Dec. 5 conference on that action – just 10 days before the Electoral College meets. The high court’s only African American has made the request to his colleagues as a result of an emergency stay request filed by attorney Leo Donofrio, the newspaper said. Donofrio sued New Jersey Secretary of State Nina Wells, contending that Obama was not qualified to be on the state’s presidential ballot because of Donofrio’s own questions about Obama’s status as a natural-born U.S. citizen. Obama was born in Hawaii.

Black Republican challenges Obama’s citizenship. Former presidential candidate Alan Keyes and other members of the party have filed suit in California Superior Court in Sacramento to stop the state from giving its electoral votes to President-elect Barack Obama until the former Illinois Senator provides documentary evidence that he is indeed is a natural-born citizen of the United States, according to the American Independent Party.
