Texas Man Is Exonerated In The Killing of Two Burglars

A 62-year-old Texas man who shot to death two men who he believed ha just burglarized his neighbor’s home will not be put on trial, a grand jury determined Monday. For many people who have been watching this case closely over the past eight months, Joe Horn is a hero, who did what was necessary to defend his neighbor’s property. But for others, Horn is not only a vigilante but a ruthless killer, who without remorse shot two men in back with a 12-guage shotgun. The latter would like Horn to stand trial and ultimately be convicted and go to prison for his actions. On Nov. 14, Horn called 911 to report that someone was stealing from neighbor’s house. The dispatcher told him to stay inside, but a stubborn Horn engaged the men, eventually shooting them to death. Critics argue that had the victims been White, and not Latino, he would have been arrested – even though Texas law allows people to protect themselves with a gun, and even kill a perpetrator if they believe their life is in danger. Speaking to The Houston Chronicle Monday, Frank Ortiz, of the Pasadena , Texas , chapter of the League of United Latin American Citizens, he was the FBI to investigate. “That’s amazing that they would no-bill him with so much evidence against him,” Ortiz said. “This was no more than a vigilante.” Countered Tom Lambright, Horn’s attorney: “He wasn’t acting like a vigilante. He didn’t want to do it.” Rather, he said, a frightened Horn merely tried to defend his neighbor’s property and only fired when the two men entered his yard and threatened him. “He was scared. He was in fear of his life,” he said. Harris County District Attorney Kenneth Magidson said, “I understand the concerns of some in the community regarding Mr. Horn’s conduct. The grand jury concluded that Mr. Horn’s use of deadly force did not rise to a criminal offense.” The two victims, 38-year-old Hernando Riascos Torres and 30-year-old Diego Ortiz were jobless illegal immigrants from Colombia . Torres had been deported in 1999 after being convicted on an earlier cocaine charge.

mmgood: I don’t have a low opinion of Blacks. I have a low opinion on Blacks (and people of all races) that do wrong, or are ignorant. They are the people I write negative comments about…not all Blacks. There are many successful/smart Black people, obviously.
Extra-curricular activities? Friends? YOU would be surprised at how well i do, and the friends that i have. I’m not going to sit here and try to prove this, as that would be a waste of time. Peace.

Do not say ‘material things are not worth a life’, because: 1) the thieves took their lives into their hands when they broke into a strangers’ house. 2) what they steal just might ruin the victims’ life. Everyone is not so well-off to be able to simply relace what was stolen
The neighbor, in this case probably didn’t know whether or not his neighbors were inside bound, raped or dead. He was his brothers’ keeper.

I don’t get why the guy was not charged if he disobeyed the dispatchers’ order to stay inside.
His life did not seem to be in danger if they were running away from him and he wouldn’t have had to worry about retaliation from them if he had kept his butt inside his home.

To UMLaw they were both black men here illegally from Colombia. From the pictures that I saw of them if you were to have seen them on the street and not hear them talk you would not know they were Colombians. I can’t understand how anyone can say that man was racist. You don’t think he would have shot 2 white burgulars? I wish he was my neighbor. I’m tired of criminals who believe that they can just take from hard-working people who make the effort to work, get an education, etc. and make the sacrifices it takes to get by in the world only to have some immoral, lazy, bum come into their home and take what doesn’t belong to them. If any person be it black, white, Latino, Asian, European, enters my house uninvited, to violate and disrespect me or my neighbor, I would do the same thing. If no one would’ve stopped the theives from going into his neighbors house, they would’ve been back the next day robbing his. Any of us know that if we trespass or attempt to rob someone, they have the right to protect their property, and we are taking our lives into our own hands. I’m glad to see that there are still people who aren’t self-centered and care about others. I guarantee that nobody else will be trying to rob that neighborhood. Those lazy bastards need to get a job and EARN what they want instead of taking it!

Although it sounded extreme, the man was dismissed by a grand jury. We weren’t there to really judge him or the two dead burglars. I’ll tell you what ; in Vietnam he could get a trophy but in the USA we may want to take a step back before we rush to any judgement.
