Troy Davis Execution Delayed Again
August 18th, 2009Troy Davis, the condemned Georgia inmate who maintains that he is not the man who murdered a Savannah Police officer 20 years ago, will stay alive long enough to try and prove his innocence, the U.S. Supreme Court ruled Monday. Siding with Davis were Justices John Paul Stevens, Ruth Bader Ginsburg and Stephen Breyer. Sonia Sotomayor, who was sworn in earlier this month, did not vote on the inmate’s petition. Stevens ordered a federal judge to “receive testimony and make findings of fact as to whether evidence that could not have been obtained at trial clearly establishes petitioner’s innocence.” Davis, whose accusers have recanted their testimony against him in recent years, has found support among a diversity of high-profile figures, including the pope; former President Jimmy Carter; former South African Archbishop Desmond Tutu; actors Susan Sarandon and Harry Belafonte; and a host of current and former lawmakers from across the political spectrum. In recent years, Davis has seen his execution halted three times. In June, his supporters delivered petitions bearing about 60,000 signatures to Chatham County, Ga., District Attorney Larry Chisolm, demanding a new trial. Although there was no physical evidence tying the then 19-year-old Davis to the 1989 killing of Officer Mark MacPhail, he was convicted and condemned to death on the testimony of witnesses. Over the past 18 years, seven of the nine witnesses have withdrawn their claims. As expected Justices Antonin Scalia and Clarence Thomas, the high court’s only African-American, objected to the court’s decision Monday, calling it a “fool’s errand.” Wrote Scalia, “Petitioner’s claim is a sure loser. Transferring his petition to the [federal] District Court is a confusing exercise that can serve no purpose except to delay the state’s execution of its lawful criminal judgment.” Last October, the U.S. Supreme Court declined to intervene, and a federal appeals court in Georgia granted a temporary stay of execution.

As a Conservative who believes that the death penalty needs to be used to combat some crimes, including the crime for which Troy Davis has been charged, I usually support the execution of those whose appeals have been turned down. With that said, I believe that executing Mr.Davis could be a serious miscarriage of the very same judicial system that I support. I think that if he is guilty, after all the close calls that he has had with execution, he has suffered more than he deserves.
Why we still spending our tax dollas on this no good N###a??? He should have been injected already. all them tax dollas keeping him alive till today could of got me some nice dubs on my ride and then some. Naw meen??

If Troy was found guilty and the evidence (sooner or later) supports it….he should be executed right away….just like the policeman was. ok, some of you responding to this article are obviously seriously misguided or just stupid. the point that the court is trying to make by staying the execution is to make sure that an innocent man is not put to death for something that he didn’t do. granted it all comes back down to race, but really, what does that matter???? the purpose of the judicial system is serve as just and righteous punishment as possible. i work in the judicial system and I have some problems with this case. first of all- how many cases have you seen in the past year where people were sentenced to death back in the late 80’s and early 90’s and are now free because they were convicted with no evidence and testimony from people who have either recanted their stories or been deemed not credible?????? if he did do it, he deserves to be punished. but if he didn’t, he deserves to be released. Justice doesn’t always prevail- I think the court is trying to do their best to make sure it does in this case.

Troy davis, should bring back the police officer He ! murderd than he would not have a problem. You people teach MEME to your childern than go around and say we are victims ? But you people are your own victimizers! And are unscrupulous .
PJ I agree with you. Just the mere fact that over half of the witnesses have withdrawn their claims is enough to at least have another trial.
How many people of color have been wrongly accused of killing white people? How many are in prison and wrongly accused? There have to be people in jail or prison because if there is no quota there will be not jobs for the people who work in prisons. The state makes money by having prisoners male license plate and are sold for 1000 times more then what it cost to made them. Just review the evidence and see if there is any evidenc tying him to the crime

It is soo sad. I am glad the death penalty is not practiced in UK. im sorry to say but i think the US judicial system is corrupted. I have noticed majority of the people on death row are always blacks or hispanics..i think there is a bigger question behind this.
