Obama Says “The Rule of Law” for the Supreme Court Justice

May 1, 2009 – The president decided to stop by the daily press briefing Friday to let everyone know he had spoken with Associate U.S. Supreme Court Justice David Souter regarding his plans to retire from the bench.

Souter’s announcement was the topic of the briefing from the beginning – so reporters, including myself, were shocked to get answers about the resignation directly from the president and in such short order.

The president interrupted press secretary Robert Gibbs’s briefing to report he had just spoken to Souter and then read a brief statement.  He praised Souter for being a “fair-minded” and “independent judge.” 

“He came to the bench with no particular ideology.  He never sought to promote a political agenda.  And he consistently defied labels and rejected absolutes, focusing instead on just one task — reaching a just result in the case that was before him,” Obama said.
 
And what kind of judge will Obama look for to replace Souter?  Obama said, “I will seek somebody with a sharp and independent mind and a record of excellence and integrity.  I will seek someone who understands that justice isn’t about some abstract legal theory or footnote in a case book; it is also about how our laws affect the daily realities of people’s lives — whether they can make a living and care for their families; whether they feel safe in their homes and welcome in their own nation.”

As a former constitutional law professor, the president  added, “I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role.  I will seek somebody who shares my respect for constitutional values on which this nation was founded and who brings a thoughtful understanding of how to apply them in our time.”

Now we’ll have to wait and see who the president identifies as meeting the criteria to fill a seat on the highest court in the land.  Early speculation is he’ll select a woman, even more speculation is that he’ll select the first Latino to the bench. No one really knows, but I recall the same beltway chatter when President Bush was looking for his two appointments;  Bush named two men to the bench.

I’m sorry I can’t take Obama serious. He says he wants someone “dedicated to the rule of law”, but that did stop him from appointing the tax cheat Tim Geitner.
He also mentions “honors our constitutional traditions” but during the campaign he talked about how the constitution was an obstacle for Americans.

I will say this; it’s going to be a “no win” for him. If he picks a black, latinos will be mad (and vice versa). If he picks a male, women will be mad. I say pick a sexy latino woman so everybody will be kind of happy.
